Madison, WI — Today, State Senator David Craig (R-Town of Vernon) responded to the Wisconsin Supreme Court Decision in the Milewski v. Town of Dover case reversing the lower court’s decision allowing a property owner to be penalized for refusing entry to a municipal assessor. Justice Daniel Kelly wrote the lead opinion asserting the Plaintiffs’ 14th amendment due process rights were violated in this case. Senator Craig released the following statement:

“The Supreme Court’s decision today is a clear affirmation of individual property rights and due process rights here in Wisconsin. I am pleased that Vincent Milewski and Morganne MacDonald were vindicated in exercising their statutory and constitutional rights.

“This case has illuminated a glaring inconsistency within Wisconsin statutes which forces a homeowner to choose between their property rights and their due process rights. I will continue to push passage of Senate Bill 158 that provides a remedy for this major flaw in our law and aligns our statutes with the Wisconsin Supreme Court decision.”

Senator Craig represents the 28th Senate District which includes parts of Waukesha, Milwaukee, Racine, and Walworth counties.
