‘The Facts in the Case and First Amendment to U.S. Constitution Are Clear’

MADISON, Wis. — One Wisconsin Now today asked for summary judgement in their lawsuit against State Representatives Jesse Kremer, John Nygren and Robin Vos over their blocking of the group on the Twitter social media platform.

The case, One Wisconsin Now v. Kremer, et. al., filed on behalf of One Wisconsin Now in the Western District of Wisconsin U.S. District Court by Attorney Christa Westerberg at the Pines Bach law firm, challenges elected officials on Twitter, acting in their official capacity, from “blocking” citizens and organizations and therefore preventing them from participating in the online public forum by keeping them from viewing and commenting on the blocking users tweets on their Twitter accounts.

A recent federal court ruling in another case held that Donald Trump cannot block Twitter users based on their political views.

The following are the statements of One Wisconsin Now Executive Director Scot Ross regarding the filing:

“The facts in our case and the First Amendment to the United States Constitution are clear.

“Representatives Vos, Nygren and Kremer created a public forum in their capacity as public officials. They cannot turn around and then suppress free speech or exclude citizens from participating because they don’t like what they hear or read from people with differing views.”
