MADISON, WI — In the wake of Justice Kennedy’s retirement, Democratic gubernatorial candidate Kelda Roys is raising the alarm about Wisconsin’s current abortion ban, already on the books. While the law is unenforceable due to the 1973 Supreme Court decision in Roe v. Wade, it would immediately go back into force should Roe be overturned – making abortion illegal in Wisconsin in virtually all circumstances.

With the retirement of Justice Kennedy, President Donald Trump will likely appoint a Justice who will cast the 5th and final vote needed to overturn Roe. v. Wade.

Kelda Roys released the following statement:

“If Roe v. Wade is overturned, abortion will immediately become illegal in Wisconsin. It will be illegal even in cases of rape, incest, and grave danger to a woman’s health. Victims of sexual assault and domestic violence will be forced to bear the children of their abusers.

“The only exception is if the woman will otherwise die – something that is very rare, and often impossible to foresee until it’s too late. Even in those cases, many doctors will be unwilling to risk prison time. This cruel, dangerous, archaic abortion ban must be repealed immediately.

“Every Wisconsinite who cares about the physical and economic well-being of women and families must now confront the likely reality that Roe will be overturned in the very near future, and abortion will again be a crime in Wisconsin.

“As governor, I will seek immediate repeal of the Criminal Abortion Ban, and I will pardon any provider charged under the ban. I am the mother of two daughters and two stepdaughters who deserve to control their own destinies. I am the great-granddaughter of a woman who died of a self-induced abortion. I am a lifelong feminist who has worked to advance reproductive rights as a legislator, attorney, and former executive of NARAL Pro-Choice Wisconsin. I will never compromise on our right to control our own bodies and lives.”
