Madison, WI — Republican leadership in the Legislature will move to intervene today in a case being brought in the federal courts that seeks to undermine Act 10. With the announcement, Majority Leader Scott Fitzgerald released the following statement:

“We aren’t picking this fight – once again a liberal group is trying to change laws that have been passed by the Legislature and previously upheld by the courts. We cannot sit idly by and allow our attorney general or governor an opportunity to undermine Act 10, and will seek to intervene in this case accordingly to make sure that the law is upheld.”

The union-led lawsuit, brought by Operating Engineers Local 139 and IUOE Local 420, seeks to challenge the constitutionality of Act 10 in federal courts – despite the law being upheld by the courts over the better part of the last decade. In fact, the plaintiffs have not pointed to any court that has accepted their legal theory.

During his campaign for governor, Evers backed repealing Act 10. The unions filing this lawsuit contributed thousands of dollars to Attorney General Kaul and Governor Evers during the last election cycle.
