[Madison, WI]  Today, the Legislature filed its opening brief in SEIU vs. Vos in the Wisconsin Supreme Court, and as well as filing a petition for original action to require Attorney General Josh Kaul to comply with the law. Kaul sought to evade the Supreme Court’s order in SEIU, and has failed to comply with existing state law. The attorney general refuses to send Department of Justice cases to the Legislature’s Joint Committee on Finance for settlement review, and has failed to deposit new settlement money into Wisconsin’s general fund. The general fund is used to fund state government functions.

Following the filing, Senate Majority Leader Scott Fitzgerald (R-Juneau) and Assembly Speaker Robin Vos (R-Rochester) released the following joint statement:

“Attorney General Kaul is taking an unrealistic view of the law and refusing to comply with previous court rulings. State law requires Kaul to send cases to the Joint Finance Committee to review and to deposit all settlement money in the general fund, where it can be used on priorities such as schools or health care. It is egregious that Attorney General Kaul is playing a game of political keep away with potentially up to $20 million in funds that belong to hard-working Wisconsinites.

“We hope that the Supreme Court will act to ensure that the attorney general finally complies with our laws.”
