Madison, Wis. — Former Wisconsin Supreme Court Justice Daniel Kelly, the senior fellow in constitutional governance at IRG, congratulated lawmakers today after the Senate voted to support a joint resolution that would overturn Gov. Evers’ latest attempt to use unauthorized emergency powers in response to the COVID-19 pandemic.

“I commend the Senate for ending the governor’s continued use of emergency powers that expired eight months ago,” said Justice Kelly. “Responding to the pandemic is serious business, but emergencies and good intentions do not excuse the governor from following the law. I hope the legislature continues asserting its primacy in setting public policy for the state of Wisconsin.”
