Madison ­­– Last week, August 24, 2022, the United States Department of Homeland Security released its final rule on Deferred Action for Childhood Arrivals (“DACA”). The final rule preserves the DACA program by maintaining the existing eligibility criteria to receive DACA and reaffirming the purpose behind DACA.

RISE Law Center applauds DHS’s efforts to reaffirm and fortify this crucial program – although an injunction stops the adjudication of any initial DACA applications, this rule is a step toward making the DACA program more accessible. RISE Law Center recognizes that not only does DACA help any recipient to become economically self-sufficient and pursue education and career goals with reduced concern of deportation, but DACA can also be an important protection for particularly marginalized immigrants. When survivors of domestic violence are able to receive DACA, it makes them more likely to leave an abusive situation and seek out supportive resources.

“Preserving DACA is crucial to the wellbeing of many clients we serve at RISE Law Center,” said Robin Dalton, Director of RISE Law Center. “Now, we call on Congress to pass legislation to expand DACA eligibility and establish a path to permanence in the United States for DACA recipients.”
