Dear Attorney General Garland:
As a representative democracy, both the rule of law and the will of the people are necessary parts of our system of government. It is our belief that both of these principles were broken when ten men and women met in secret in the Wisconsin State Capitol on Monday, December 14, 2020, and completed documents falsely claiming to be Wisconsin’s true Presidential electors and casting their “votes” for Donald J. Trump for President and Michael Pence for Vice President. This came just hours after the Wisconsin State Supreme Court had issued a ruling affirming Joseph R. Biden, Jr. and Kamala Harris as the winners of the 2020 Presidential election in the state of Wisconsin. These false documents were part of a multi-state scheme to, at best, cast doubt on the election results or, at worst, subvert the will of the people and throw the Presidential election to Donald Trump and Mike Pence.
There is significant reporting and documentation demonstrating that these fraudulent electors knowingly misrepresented themselves and the election results and did so at the behest of the Trump campaign. In fact, Robert Spindell, a Republican appointee to the Wisconsin Elections Commission who was one of the ten fake Wisconsin electors signing the documents in support of Trump, is quoted as saying, “As an elector, I only performed ministerial duties for the Republican Party of Wisconsin and Trump campaign.” The fraudulent documents, signed by the fake electors and declaring Trump the winner, were submitted to a number of state and federal governmental bodies for entry into the official record. These documents and the processes by which they were created, signed and submitted are strikingly similar to documents and actions conducted in nine other closely contested states.
The attempted interference in a federal election and the likely coordination between the Trump campaign and Republican parties and activists in multiple states make this a matter of federal law; as such, we request that you use the full force of the Department of Justice to investigate the actions of these ten electors, fraudulent electors in other states, and any party or campaign officials who may have been involved in this attempted coup. Inaction on this matter would simply invite further interference in future elections. Events following the 2020 election have shown how fragile our democracy can be; any attempt to circumvent the electoral process should be punished before it happens again.
