This week, a group of prosecutors asked a Wisconsin judge to toss out Attorney General Josh Kaul’s lawsuit challenging Wisconsin’s abortion ban.
Dane County District Attorney Ismael Ozanne, Milwaukee County District Attorney John Chisholm, and Sheboygan County District Attorney Joel Urmanski all filed separate motions to dismiss the case, arguing that the lawsuit lacked legal merit and seeks to improperly restrict prosecutorial discretion. They further argue that Attorney General Kaul lacks standing to sue because he has not been personally harmed by the ban.
In the months since the U.S. Supreme Court overturned Roe v. Wade in Dobbs v. Jackson Women’s Health Clinic, Governor Evers and Attorney General Kaul have been unwilling to enforce Wisconsin’s anti-abortion statute (940.04), which includes exceptions for medical emergencies and the life of the mother. They have not only brought a direct legal challenge against the law, but the Governor also called two separate special sessions of the state legislature in the aim of overturning the law.
Gracie Skogman, Wisconsin Right to Life’s legislative/PAC director responded, “Wisconsin’s abortion ban has saved countless lives in Wisconsin, and Attorney General Kaul should be focused on addressing the needs facing women and their preborn children in Wisconsin instead of undermining this law.”
Skogman continued, “We applaud the efforts of this group of prosecutors and join them in their call for the case to be dismissed.”
