In response, Representative Andrew Hysell (D-48) released the following statement:
“The Supreme Court of Wisconsin released its decision today repealing Wisconsin’s archaic 19th century abortion ban. Their reasoning was straightforward: since the 1849 abortion ban, the Wisconsin Legislature has passed many laws that recognize the legality of abortion by dictating when, where and how abortions can be performed. It’s well established in Wisconsin that older laws are repealed by the passage of newer laws that ‘revise the entire subject’ of the older law.
“The Wisconsin legislature speaks for the people, and the Wisconsin State Supreme Court has rightfully listened to the legislature and its implicit repeal of the 1849 law.”
