MADISON, WI – MADISON – This morning, the Wisconsin Supreme Court removed Wisconsin’s pre-Roe protections for the unborn in Kaul v. Urmanski. Wisconsin Statute § 940.04 protected the unborn from the moment of conception through natural birth. Now, because of the activist Supreme Court, unborn human beings will be killed through the first five months of pregnancy in the Badger State.
Wisconsin Family Action (WFA) along with other pro-life groups attempted to intervene in this case last year to speak on behalf of pro-life individuals around Wisconsin. Unfortunately, liberals on the Court showed their hand by not even allowing voices on behalf of the unborn to be heard through intervention in Court on this essential issue.
WFA President Daniel Degner denounced this morning’s ruling, “Liberal activists have made it a point to run their Supreme Court campaigns not on judicial philosophy but with their clear message that a vote for them will result in unfettered checks on the abortion industry. Once again, this politicized Court has determined to advance their leftist political agenda instead of rightly calling balls and strikes.”
Degner contends that today’s decision will negatively impact Wisconsin’s future, “The court’s actions today are less about faithfully reflecting the text of 940.04 as historically understood, and more about crafting a political win for the abortion lobby. As a result, thousands of Wisconsin children will be denied the right to live each year.”
We agree with Justice Hagedorn that, “The actual legal question at the heart of this case is whether WIS. STAT. § 940.04(1) is still an enforceable abortion law. Because the statute clearly prohibits abortion, and because the legislature has not repealed the provision either explicitly or impliedly through subsequent legislation, the answer is an easy and emphatic yes.” (Kaul v. Urmanski, 2025, WI 32, ¶110)
Degner concluded, “Despite the court’s decision, Wisconsin Family Action remains committed to supporting women facing crisis pregnancies and advocating for the life and dignity of every unborn child. As a ministry we will continue to work with churches and parachurch ministries to create a culture throughout Wisconsin where life is cherished.”
