The News: The Trump Administration has filed a motion declining to defend multiple Biden-era aid programs within the Department of Agriculture (USDA), each of which currently discriminate against white male farmers. The Department of Justice (USDOJ) stated in a court filing that the challenged federal programs are “unconstitutional to the extent they include preferences based on race and sex.” USDOJ’s motion followed WILL’s lawsuit on behalf of Adam Faust seeking to remove race-based or sex-based consideration for farmers for its loan, commodity, and conservation programs.
The Quote: WILL Deputy Legal Counsel, Dan Lennington, stated, “This lawsuit served as a much-needed reminder to the USDA that President Trump has ordered the end to all federal DEI programs. There’s more work to do be done, but today’s victory gives us a clear path to do even more in the name of equality.”
Our Client: Adam Faust is a dairy farmer from Chilton, Wisconsin. He is one of the 2 million white male American farmers (60% of all farmers) who are still subject to discriminatory race-based policies implemented by the Biden administration’s USDA. For years, Mr. Faust has battled against unconstitutional discriminatory USDA programs.
In a landmark 2021 victory, he was the first farmer to successfully sue the Biden Administration for race discrimination in the Farmer Loan Forgiveness Plan. Despite his efforts, Mr. Faust is still subject to several race-based policies that continue to hurt millions of farmers nationwide.
Fighting for Equality: Since 2021, WILL has represented over 80 clients in 25 states as part of its Equality Under the Law (EUL) Project and has won seven times in court, including Faust v. Vilsack. Several of our cases are still pending.
