Madison, WI – Today, Governor Tony Evers vetoed Senate Bill 431, introduced by Representative Cindi Duchow (R–Delafield) and Senator Van Wanggaard (R–Racine). The bill sought to clarify that employers do not violate Wisconsin’s Fair Employment Act when terminating an employee over pending, non-criminal charges that are substantially related to their job.
“I introduced this legislation to address confusion following a recent Wisconsin Supreme Court ruling that left employers in limbo,” said Rep. Duchow. “I’m concerned this uncertainty will lead to employees being terminated prematurely, before any law enforcement investigation, because employers fear having their decisions overturned in court. That puts both employees and employers in a difficult position with no good outcomes. This bill would have resolved that issue, and I’m disappointed it was vetoed.”
