The News: The U.S. Equal Employment Opportunity Commission (“EEOC”), and Generac Power Systems, Inc. (“Generac”) have reached a settlement regarding Wisconsin Institute for Law & Liberty’s (WILL) client, Spencer Wimmer. WILL filed a Title VII complaint with the EEOC on Spencer’s behalf based on the denial of his request for a religious accommodation.

In addition to monetary relief, the agreement reached by the company and the EEOC requires Generac to reissue its religious accommodation policies and provide training with the goal of promoting greater understanding and effective handling of religious accommodation requests going forward. EEOC’s press release is available on its website. The settlement closes Spencer’s complaint.

The Quotes: WILL Deputy Counsel, Luke Berg, stated, “We applaud Generac for resolving Spencer’s complaint and agreeing to reissue their policies and update their procedures around religious accommodation requests. We are proud to have represented Spencer and stand ready to defend religious liberty anywhere it is threatened.”

WILL Client, Spencer Wimmer, stated, “I am deeply grateful for WILL’s effort defending my rights in the workplace.”

Background on the Case: As alleged in WILL’s complaint, Spencer’s Christian religious beliefs prevented him from using preferred names and pronouns that do not align with an individual’s biological sex. He asked for a religious accommodation to ensure he would never be compelled to violate his religious beliefs, but he was denied. WILL filed a complaint with the EEOC in May 2025.
