Madison, Wis: Today, Liberal Justices on the Wisconsin Supreme Court voted 4-3 to invalidate the 1849 Abortion Ban in Wisconsin. This is a win for advocates, organizers, and everyday Wisconsinites across our state who made their voices heard.
After the court’s decision, Representative Ann Roe (D-Janesville) released the following statement:
“This is a critical first step in our battle to protect a woman’s right to make her own healthcare decisions and pursue her own dreams with freedom.”
Rebecca Dallet wrote for the Wisconsin State Supreme Court majority’s opinion stating:
“We conclude that comprehensive legislation enacted over the last 50 years regulating in detail the “who, what, where, when, and how” of abortion so thoroughly covers the entire subject of abortion that it was meant as a substitute for the 19th century near-total ban on abortion. Accordingly, we hold that the legislature impliedly repealed.”
