Madison – Today, the Assembly Committee on Judiciary held a Public Hearing on Assembly Bill 311, relating to: changing an individual’s sex on a birth certificate, authored by Representative Lindee Brill (R-Sheboygan Falls) and Senator Steve Nass (R-Whitewater). If passed, AB 311 would ensure that a birth certificate remains a reliable and biologically factual legal document in the State of Wisconsin.
Specifically, it prevents the alteration of a birth certificate to reflect a sex other than a person’s biological sex. Legislators, representatives of interest groups, medical professionals, and members of the public testified both in favor and against the bill. Representative Brill offered the following comment about the hearing:
“AB 311 is basic, common-sense legislation to ensure our birth certificates reflect reality, not ideology or feelings. In their testimony, several opponents of the bill mistakenly referred to the sex designator on a birth certificate as a ‘gender marker.’ This error reveals precisely why this bill is so necessary. A foundational legal document like a birth certificate must be firmly rooted in scientific reality, in biological sex, not subject to the whims, vagaries, and fluidity of a person’s subjective experience of ‘gender.’
