The News: The Wisconsin Institute for Law & Liberty (WILL) issued a statement in support of the Wisconsin State Assembly for passing the “Equality Amendment,” otherwise known as Assembly Joint Resolution 102 (AJR 102). This is a proposed amendment to the Wisconsin Constitution that prohibits state and local governments from discriminating against or granting preferential treatment to individuals or groups based on race, sex, color, ethnicity, or national origin in public employment, public education, public contracting, and public administration.  

The Statement: WILL Managing Vice President and Deputy Counsel, Dan Lennington, stated, “The Equality Amendment will end discriminatory DEI programs throughout Wisconsin. These policies hurt countless parents, children, employees, small businesses, and average Wisconsin citizens every day. We commend the State Assembly for taking this important step. Now, the State Senate should move quickly to finish the job and give Wisconsin voters the chance to weigh in.” Lennington testified in favor of the amendment on January 7, 2026.  

Widespread Public Support: According to a 2024 Marquette Law Poll, 75% of Americans supported the Supreme Court decision to end affirmative action in college admissions including 73% of Independents, 58% of Democrats, 77% of Hispanics and 53% of Blacks. 

In partnership with Platform Communications, WILL commissioned a poll showing over 60% of Wisconsin voters support a “Equality Amendment” to the Wisconsin Constitution, including 65% of Democrats.  

Next Steps: If approved by the Wisconsin State Senate during this legislative session, Wisconsin voters will have the opportunity to ratify the Amendment on the November 2026 ballot.
