Washington, DC – Today, Rep. Ron Kind voted the Protect Older Job Applicants Act. This legislation will codify and clarify protections for older job applicants in the Age Discrimination in Employment Act (ADEA). Currently, two federal circuit court decisions have ruled that certain ADEA federal anti-age discrimination provisions only apply to employees, leaving job applicants without the protections they deserve.

“Everyone should get a fair shot when they apply for a job,” said Rep. Ron Kind. “This legislation would make sure that happens and extend protections to older Americans who are seeking to return to the workforce or broaden their horizons by transitioning to a new career.”

A 2020 AARP report that revealed 76% of older workers in the United States see age discrimination as a barrier to attaining a job, underscoring the need to ensure ADEA protections are extended to older job applicants.
