Franklin, WI – Forward Latino, a non-partisan, non-profit service and advocacy organization issued the following statement following the ruling by the Court of Appeals for the 5th Circuit on the legality of the Deferred Action for Childhood Arrival (DACA) program. The program was implemented during the Obama administration and grants children who applied for the program and met the requirements including having been brought to the United States by their parents for no-fault of their own, temporary lawfully status allowing them to work in the United States.

Yesterday’s decision by the court ruled against the program implemented under President Obama. The primary complaint in the case was that the program was created and implemented via an executive memorandum issued by then Secretary of the U.S. Department of Homeland Security Janet Napolitano. While the court found the program to be unlawful, it left the current program in place as they instructed the lower-court to review the case using the new regulation created last month by the Biden Administration which followed the governments formal rule-making process in its creation.

National President Darryl Morin issued the following statement:

“While we disagree with the decision, it was not unexpected. Sadly, the decision leaves individuals who know no other country than the United States in a position of fear and uncertainty. Study after study continues to show this group of eager and talented individuals is among the most productive in our country and that the American public overwhelmingly supports allowing this group of young people to be granted a pathway to earned citizenship.

Forward Latino is confident that when the new regulations are reviewed by the lower court the plaintiff’s concerns will be at last satisfied as it was created using the federal government’s formal rule-making process.

It is important that DACA recipients and their employers know that the program is still in place and that all recipients are lawfully allowed to continue working in the United States.
