Madison, WI – Today, Governor Evers and Attorney General Kaul announced a lawsuit challenging the 1849 Wisconsin state statute that criminalizes abortion and provides no exceptions for abortions in the cases of rape or incest. This lawsuit comes after the U.S. Supreme Court’s decision on Dobbs v. Jackson Women’s Health Organization last week which overturned Roe v. Wade and the constitutional right to abortion. The state legislature convened for a special session last week to repeal the 173-year-old law, but legislative leaders ended the session in 13 seconds without debate. Following today’s announcement, Sen. Pfaff released the following statement:

 

“I appreciate and support Governor Evers and Attorney General Kaul’s lawsuit to protect the fundamental right of women to make their own healthcare decisions without government interference. The health and lives of Wisconsinites are at risk without the freedom to make these deeply personal decisions about abortion through consultation with their healthcare provider, family, and faith.”

 

“I will not stop fighting until Wisconsin’s criminal abortion ban is repealed and the reproductive healthcare freedoms under Roe v. Wade are codified in law.”
